Little correction with regards to UK law.
You can be prosecuted for posession of CP or other illegal material (i.e. beastiality) irrespective of;
1. Whether it arrives in an insolicited e-mail
In this case, if it arrives via e-mail, and you actually open that e-mail, a copy of the images are downloaded to your computer, which is all they need to prosecute (using plain text only e-mail will prevent this)
2. Whether you accidentally click the wrong link in a search result
If for example, and this has happened to some, you are searching for hats, you may click a link that looks like it contains what you're looking for, but instead, it redirects you to illegal material (much like the blackhat SEO campaigns that redirect you to malware)
3. You are on a site and the site loads a popup containing illegal material
In all three cases, you could still be guilty of posession under UK law.
Important: I am not a lawyer, I am simply stating the interpretation of UK laws relating to this, as I read them, and as has been reported many times by the likes of the BBC, crimestoppers/watchdog, newspapers and other entities. I'd strongly urge you speak with a lawyer or your local law enforcement to get this situation clarified - better safe than sorry

Hello MysteryFCM .Thank you for making that a bit more clearer.It is very scary to think that you are guilty of a crime from accidently opening an email or click a link that is nasty.If i set my email to text only wont i be turning it off and on to view safe emails all the time,That would do my head in but if thats what you have to do then i suppose needs must..

I've always advocated plain text e-mail over HTML, specifically because it provides for protection against malicious content embedded in said e-mails.
As far as this issue, sadly, those guilty of such, have often and continue, from what LE tells us, to use the "I found it accidentally" or "my PC was infected" arguments, which is why LE tends to ignore these, until such time as proof is provided to corroborrate the story, and even then, the likely hood of their believing you is slim to none.

I can understand the LE approach. I mean, I'm sure they hear those kinds of excuses very often, especially from pedophiles. So it makes some sense that they would leave judgments where they belong . . . the court.
However, I would think that an accused would be able to corroborate their story given a court whose purpose it is to listen to stories if indeed they were innocent. (Of course, prior history of pedophilia doesn't help . . . so if you've been there before, even if you were found innocent, that's already a strike against you).
Nevertheless, that leads to several undesirable outcomes even if found innocent. Not the least of which would be the stigma of being arrested for CP. Also, it might be financially burdensome to post bail while you're waiting to tell your story of innocence. And you definitely wouldn't want to find yourself in there a second time.
But, if you somehow get tangled in this mess, my sense is that a sane court would be able to see if you're innocent or not.
However, the moral of the story is . . . don't take the risk in the first place, and that way you won't be waiting for your "day in court". (Of course, there's always the chance that you'll get an insane judge or jury . . . in which case you'll find yourself among all the other prison inmates that claim they were "innocent").

I actually like the LE approach to a point. Obviously, it's got it's major downsides. For example, first and foremost, Average Joe isn't going to know what caused it in the first place, and thus, explaining it would be difficult, if not impossible, let alone proving it.
Secondly, even those of us that do know what we're doing are going to find it difficult for one simple reason - alot of the sites that do drop this type of stuff, are only live for upto 24 hours max. Traffic reports from the users ISP may help, but only as far as what sites were visited in order. The traffic reports won't show what site led to what, or what site loaded what, as traffic filters at the ISP level, typically don't log that information to my knowledge.
As mentioned, the moral of the story here, is to take precautions to begin with, so you don't end up in that situation if you can help it. Being very careful about what you click and where you go, is certainly a good idea, but not fool proof. Disabling HTML e-mail, and scripting (in the browser) will prevent 99% of this stuff - but then of course, you've got the downsides of doing that (something I've covered before, so won't go into again).

Thanks! phantazm and demonluo..Sorry for late reply well that is good to know.If i do get any nasty stuff report it right away and i am doing the right thing and should be ok with the law,I would never open or reply to anything that dose look suspect....

Hi all,while Sites that try to steal your personal information is important to me it is not what worries me the most my biggest fear!! is getting a sick email or link on a site or a infection of really sick porn and child abuse pics pop up's...From a program on tv in the uk recently The vice squad in soho london an officer said if its on your PC you are guilty of a sex crime especially peado material...Could someone here tell me if this happened to you with out knowingly looking for such material is there a deffence to say it was an infection??
