WOT Trust Tool Service

By logging in to the WOT Trust Tool Service (“Service”) you accept the WOT Trust Tool Service Terms and Conditions, which constitute legally binding agreement (“Agreement”) between you and WOT Services Oy (“WOT”). Subject to these WOT Trust Tool Service Terms and Conditions WOT provides to you as the subscriber of the Service the opportunity to inform visitors to your website under one domain (“Domain”) about the website’s reputation as recorded in the WOT database. The features included in the Service depend on the chosen option and are described here (compare the products)

The right to include the WOT Trust Seal is conditional to the domain having a good reputation in the WOT database, and the right will be canceled if the reputation in any of the dimensions falls below the green limit or reputation rating ceases to exist. The child safety dimension is not included in this consideration. At such time you will retain the right to use the RATE US button, but not the WOT Trust Seal. WOT has the right to amend the Service and the WOT Trust Tool Service Terms and Conditions from time to time. By continuing the use of the Service you accept the amendments.

Responsibilities of WOT

WOT provides the Service only to subscribers who have paid the required subscription fees. The reputation rating in the WOT database is generated by calculating ratings provided by the WOT community and trusted sources. The ratings include also lists of phishing and spamming websites and websites that are known to spread viruses. WOT does not take any responsibility for their accuracy or any consequences resulting from a rating. The comments provided by members of the WOT community and trusted sources are provided under the sole responsibility of the person who has originated the content. WOT does not control, monitor or have any detailed knowledge of the content and other information presented and received through the use of the Service. By providing the Service WOT does not recommend any single website or web service.

Responsibilities of the Subscriber

As the subscriber you shall:

• pay the required subscription fees as informed in the sign-up process on the mywot.com website;
• identify yourself as required in the sign-up process and provide an e-mail address for communication; and
• comply with these WOT Trust Tool Service Terms and Conditions.

As the subscriber you have the right to insert the chosen Trust Tool and features included to the chosen option under your Domain in the original form without any modifications.

No warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW WOT MAKES NO WARRANTY OR REPRESENTATION, EITHER EXPRESSED OR IMPLIED WITH RESPECT TO THE AVAILABILITY OF THE SERVICE, THE CONTENTS, INFORMATION AND DATA PROVIDED THROUGH THE SERVICE, THEIR QUALITY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, NOR TO THE FEATURES PROVIDED BY THIRD PARTIES. AS A RESULT, THE SERVICE IS PROVIDED “AS IS”AND YOU ARE ASSUMING THE ENTIRE RISK AS TO THEIR QUALITY AND PERFORMANCE.

You understand and acknowledge that WOT will not be liable for network-related problems attributable to the operation of the Service or your Domain.

Limitation of liability

YOU EXPRESSLY AGREE THAT WOT SHALL IN NO EVENT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS AND GOODWILL, ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE, even if advised of the possibility of such damages. In particular, and without limitation, WOT shall have no liability for any information used for ratings, including the costs of recovering such information. Your only right or remedy with respect to any problems or dissatisfaction with the Service is to cease use of the Service. WOT SHALL NOT BE LIABLE FOR THE VALIDITY AND CORRECTNESS OF THE DATA AND INFORMATION PROVIDED THROUGH AND IN CONNECTION WITH USE OF THE SERVICE. ANY USE OF THE ADVICE, RATINGS OR INFORMATION OBTAINED THROUGH THE USE OF THE SERVICE SHALL BE DONE AT YOUR OWN DISCRETION.

Termination

Your right to use the Service continues until the Agreement is terminated. The Agreement terminates automatically upon the expiry of the subscription period unless you have renewed the subscription and paid the subscription fee for the next subscription period. This Agreement will automatically terminate during the subscription period if you fail to comply with the material terms of this Agreement or if you cease to use the Service. Upon any termination, you agree to remove all links and references to the Service and features included to it from your website under the Domain. You will not be refunded any part of subscription fee, if any.

Provisions of Sections No Warranty, Limitation of Liability and Termination shall survive any termination of this Agreement.

Other terms

Severability. If any of the terms, or portions thereof, of this Agreement are invalid or unenforceable under any applicable statute or rule of law, the court shall reform the Agreement to include an enforceable term as close to the intent of the original term as possible; all other terms shall remain unchanged.

Whole Agreement. This Agreement constitutes the entire agreement between you and WOT relating to the subject matter hereof. Waiver. The waiver or failure of WOT to exercise in any respect any right provided for in this Agreement shall not be deemed a waiver of any further or future right under this Agreement.

Assignability. WOT may freely assign and transfer this Agreement to any third party.

Applicable law and dispute resolution

This Agreement shall be governed by and shall be construed in accordance with the laws of Finland excluding its choice of law rules. All disputes relating to the subject matter hereof shall be settled at District Court of Helsinki, Finland having the sole jurisdiction.

Methods of payment

Products and their postage are paid in conjunction with the order. The following methods of payment are available for the users of the webstore: Nordea, Osuuspankki, Sampo, Tapiola, Aktia, Nooa, Paikallisosuuspankit, Säästöpankit, Handelsbanken, S-Pankki, Ålandsbanken and credit cards. Online payments are made by using the website of Suomen Verkkomaksut Oy. Payments can be made also beforehand by bank credit transfer.

Payments by Visa, Visa Electron or MasterCard

If you would like to pay by Visa, Visa Electron or MasterCard, WOT Services Ltd. will act solely as the marketer of the respective products and services and will provide the products to the buyer. All complaints and claims for compensation will be handled by Suomen Verkkomaksut Oy. With regard to payments made by Visa, Visa Electron or MasterCard, Suomen Verkkomaksut Oy acts as the merchant of the product and the trade transaction takes place between the customer and Suomen Verkkomaksut Oy. The seller is liable to meet all the responsibilities related to the trade. Suomen Verkkomaksut Oy is also the recipient of the payment.

Cancellation policy

In case the subscriber being an Individual consumer, the subscriber may cancel the service and request a refund within 14 days of the service being issued, which subscriber has an obligation to revoke the service. Cancellations and refund requests can be made by contacting support@mywot.com.
